What are Personal Information and Business Contact Information?

Personal information is any information about an identifiable individual, other than the individual’s business title or business contact information when used or disclosed for the purpose of business communications. We refer to such business title or contact information throughout this notice as “business contact information.”

What Personal Information Do We Collect?

YOLARX collects limited personal information. Subject to ethics board approval and an individual’s informed consent, we collect the personal information of individual medical research subjects or patients, such as name and contact information (address, email, and telephone), age group, gender, medical conditions and treatments.

As a general rule, YOLARX collects personal information directly from you or from your health care records. In most circumstances where the personal information that we collect about you is held by a third party, we will get your permission before seeking this information from them (such permission may be given directly by you, or implied from your actions).

YOLARX collects business contact information directly from individuals and also from publicly available sources. The business contact information we collect includes:

  • Name
  • Title
  • Company, institution, and/or affiliation
  • Work contact information (address, email, telephone)

From time to time, we may use the services of third parties and may receive personal information or business contact information collected by those third parties when they perform services for us or otherwise. We take reasonable steps to ensure that such third parties have the right to disclose your information to us, such as requiring them to provide proof of your consent or the public source of your information.

Where permitted or required by applicable law or regulatory requirements, we may collect information about you without your knowledge or consent.

Why Do We Collect, Use and Disclose Your Information?

YOLARX collects personal and business contact information to enable us to manage, maintain and develop our business and operations, including:

  • To manage the client relationship;
  • To develop and offer our products and services;
  • To obtain supplementary information about the data sources we use in our products and services;
  • To conduct research;
  • To provide compensation to research participants.

How Do We Use and Disclose Your Information?

  • to comply with valid legal processes such as search warrants, subpoenas or court orders;
  • as part of YOLARX’s regular reporting activities;
  • to protect our rights and property;
  • during emergency situations or where necessary to protect the safety of a person or group of persons;

  • with your consent.

How Do We Get Your Consent?

It is important to us that we only collect, use or disclose your personal information where we have your consent to do so. Depending on the sensitivity of the personal information, your consent may be express, implied or deemed (for example, by using an opt-out mechanism). All communications respecting your change or withdrawal of consent must be in writing and addressed to our Privacy Officer.

If you wish to opt-out by sending us an email to the address provided below, please include “Opt-Out” in the email’s subject line and include your name and the email address in the body of the email.

Unless you advise us otherwise, we assume that you have consented to the collection, use and disclosure of your personal information as explained in this Privacy Notice.

How Do We Protect Your Information?

We protect your information by using physical, technical and administrative safeguards that are appropriate to the sensitivity of the information in question. These safeguards are designed to prevent your information from loss and unauthorized access, copying, use, modification or disclosure, both during transmission and once the information is received. However, no method of safeguarding information is completely secure. Where Is Your Information Stored?

YOLARX is located in Canada and France. We generally store your information on servers in Canada, the United States, Ireland, and Germany and at our offices in Canada and France, however, we may use service providers located in other countries. Your information could be subject to the laws and lawful access requests of governments and law enforcement agencies in other jurisdictions.

How Long Do We Keep Your Information?

We retain your information for as long as reasonably necessary for the purposes set out in this Privacy Notice. We also retain and use your information to the extent necessary or reasonable to comply with our legal obligations (for example, if we are legally required to retain your information), to resolve disputes, and to enforce our legal agreements and policies.

How Can You Update Your Information?

YOLARX wants to ensure our records about you are both accurate and current. If your information happens to change during the course of our relationship, please keep us informed of such changes, by contacting our Privacy Officer, whose information is below.

In some circumstances we may not agree with your request to change your information and will instead append an alternative text to the record in question.

How Can You Access Your Information?

You can ask to see the information we hold about you. If you want to review, verify or correct your information, please contact our Privacy Officer. Please note that any such communication must be in writing.

When requesting access to your information, please note that we may request specific information from you to enable us to confirm your identity and right to access, as well as to search for and provide you with the information that we hold about you. We may charge you a fee to access your information; however, we will advise you of any fee in advance. If you require assistance in preparing your request, please contact our Privacy Officer.

Your right to access the information that we hold about you is not absolute. There are instances where applicable law or regulatory requirements allow or require us to refuse to provide some or all of the information that we hold about you. In addition, we may have destroyed, erased, or made the information anonymous in accordance with our record retention obligations and practices.

In the event that we cannot provide you with access to your information, we will endeavour to inform you of the reasons why, subject to any legal or regulatory restrictions.
